R E S U M E N
Partiendo de la hipótesis de que el momento
constitucional ecuatoriano conjuga dos pers-
pectivas jurídicas antagónicas: el positivismo
jurídico y el enfoque iusnaturalista, el autor
sostiene que para evitar la adopción de mo-
delos extranjeros a la realidad jurídica y social
de su país, tiene que discutirse primero el con-
cepto de derecho y su significación cul tural.
Reflexiona sobre el papel protagónico que el
positivismo jurídico tuvo a lo largo del siglo XX
en Ecuador, con el objeto de discutirlo, repen-
sarlo y concederle el lugar que merece.

A B S T R A C T
Starting with the hypothesis that the Ecua-
dorian constitutional moment brings toge-
ther two antagonistic legal perspectives; the
legal positivism and the naturalistic focus I U S
gives it. The author withholds that in order to
avoid the foreign models adoption to the le-
gal and social reality of his country, the con-
cept of law has to be discus first along with
his cultural meaning. He reflects about his
main character role that the legal positivism
has had all along the X X th century, with the
means of discussing it, rethink it and allowed
it the place it deserves.
