RESUMEN
El presente artículo sostiene que el desa-
rrollo cie ntífico-técnico ha posibilitado
desde los a ños sete nta la procreación
asistida, con lo c ual se abrió un nuevo
capítulo en la re producción humana.
Esto ha dado lugar a lo que se conoce
como maternidad subrogada, cue stión
en la que la relación maternidad-pater-
nidad-filiación puede adoptar diferentes
formas. De esta manera, en un contrato
de este tipo pueden estar presentes los
padres genéticos (proveedores del óvulo
y esperma), la madre portadora o alqui-
lada (que se limita a llevar el embarazo)
y h asta los padres legales o educado-
res (s e responsabiliza n del cuidado del
niño después de nacer). Así se pu ede
hablar de madre genética, madre ges-
tante y madre responsable. La fractura
