En su momento, el maestro Guillermo Floris Margadant expuso una preocupación; pese a que diversas disposiciones legales del ámbito local ofrecían puntos de partida para establecer la responsabilidad del Estado por actos antijurídicos realizados por sus servidores públicos en ejercicio de la función pública, en México no se disponía de un sistema claro y eficaz para lograrlo. Poco tiempo después del temprano deceso del maestro, tal entorno de irresponsabilidad empieza a clarificarse en el panorama jurídico nacional con motivo de la reforma al artículo 113 constitucional (DOF-14-VI-2002) que incorporó la responsabilidad patrimonial y la expedición de la regulación secundaria que finalmente concreta sus disposiciones.

In his moment, the jurist Guillermo Floris Margadant exhibited a worry; although diverse legal dispositions of the local ambience were offering starting points to establish the responsibility of the State for antijuridical acts realized by his public servants in exercise of the public function, in Mexico there was not a clear and effective system to achieve it. A little time after the early decease of the jurist, such an environment of irresponsibility starts clarifying in the juridical national panorama owing to the reform to the constitutional article 113 (DOF- 14-VI-2002) that incorporated the heriditary responsibility and the expedition of the regulation secondary that finally concrete his dispositions
